Smoking cannabis in a public place is a civil offense: a fine up to $50 for a first finding of guilt and up to $150 for a second or subsequent one. The ban reaches parks, streets and sidewalks, bars and restaurants, public transportation and indoor workplaces. The offense is defined by smoking, so non-smoked consumption is not reached by this provision. Use is allowed on private property, though landlords may prohibit it and hotel policies vary. (Md. Code, Criminal Law 5-601(c)(4).)
