Portugal's smoking ban applies in full to nicotine e-cigarettes and heated-tobacco products. You may not vape nicotine in workplaces, public offices and services open to the public, shops and shopping centres, hotels and other tourist accommodation, restaurants, cafés and bars (including those with dance floors), museums, theatres, casinos and other venues, fairs, health facilities, schools, airports, train, bus and ferry terminals, metro stations, covered car parks and lifts, or on public transport, taxis, tourist or hire transport and cable cars, except in an open-air or smokers' area the law allows a venue to set up. The rule covers e-cigarettes that contain nicotine. Breaking it is a minor economic offence fined 150 to 500 euros for an individual.

Using a nicotine e-cigarette or a heated-tobacco product in any place listed in Lei n.º 37/2007 art. 4(1) or 4(2), or outside the open-air or smokers' areas allowed under art. 5, is a minor economic offence for the smoker (art. 25(1)(a), applied to e-cigarettes by art. 4(3)). A minor economic offence committed by an individual is fined 150 to 500 euros under the Regime Jurídico das Contraordenações Económicas, art. 18(a)(i), approved by Decreto-Lei n.º 9/2021.
