RESTRICTED

Greece's smoking-ban law never once mentions e-cigarettes - but a second law reaches over and applies that ban to them by name. So vaping is prohibited wherever smoking is: workplaces, bars, restaurants, waiting areas, stations, taxis, and any car carrying a child under 12.

Because article 24(2) of law 4419/2016 applies article 3 of law 3730/2008 to the electronic cigarette, the vehicle penalty in that article reaches a vaper on its own terms: EUR 1,500 on the occupant who uses the device in a car carrying a minor under 12 whether or not that person is driving, doubled to EUR 3,000 where the user is driving a public-use vehicle, plus withdrawal of the driver's licence for one month per violation even where a passenger and not the driver committed it. Enforcement is by police officers. The general enclosed-space fine is set by joint ministerial decision G.P. oik. 104720/2010 (Gazette B 1315) article 3, which article 24(2) also makes applicable to the electronic cigarette; that decision was not read this run, so no figure from it is published here.

§ Efimerida tis Kyverniseos (Government Gazette of the Hellenic Republic), Issue A 174 of 20.09.2016, law 4419/2016 (transposing Directive 2014/40/EU) - article 24 "Kyroseis", paragraphs 1 and 2, read verbatim this run from the authentic gazette PDF with an extractable text layer. Cross-referenced ban text: Gazette A 161 of 16.10.2019, law 4633/2019 articles 16 and 17, replacing article 3 and article 2(1)(f) of law 3730/2008 (https://www.elinyae.gr/sites/default/files/2019-12/161a_2019.pdf), also read verbatim this run and searched exhaustively for any mention of electronic cigarettes, with none found. Both PDFs mirrored by ELINYAE because et.gr redirects to a bare IP that breaks TLS name validation. Joint ministerial decision G.P. oik. 104720/2010 (Gazette B 1315) was NOT read this run - see detail.
