Prohibited. Knowingly possessing an open container in the passenger area of a vehicle on a public highway (parked or moving) is a Class C misdemeanor (fine up to $500). Exceptions: passengers in hire vehicles (bus/taxi/limo) and RV living quarters. (Penal Code 49.031.)
