The rule today

New Mexico has no law authorizing daily fantasy sports and the legal status is unsettled. In Attorney General Opinion 2025-17 (December 23, 2025), issued at the Gaming Control Board's request, the AG said he cannot categorically conclude that online DFS contests are legal under current New Mexico law, and that whether a given contest is skill or chance is a fact question he cannot resolve. Major DFS apps operate in the state; the AG has asked the Legislature to settle it.
