You cannot buy a disposable vape anywhere in New Zealand - the ban took effect 17 June 2025 and reaches selling, offering for sale, manufacturing, supplying and distributing them. It does not make owning or using one an offence, so bring your own refillable device. Vaping is banned everywhere smoking is: indoors at every workplace, bar and restaurant, and on school grounds.

The disposable-vape offence binds sellers, not users: an infringement fine of NZ$2,000, or on conviction a fine up to NZ$400,000 for a notifier or large retailer and up to NZ$50,000 for any other person (SERPA 1990, s 20FA(2)). NO FINE IS PUBLISHED for an individual who vapes indoors where it is prohibited - s 12(3) binds them but s 17 attaches no offence to a customer or visitor, so this is recorded as NOT COVERED rather than inferred. The one individual-facing penalty published anywhere is vaping or smoking in a vehicle on a road carrying a child occupant: NZ$50 infringement fee, or a court fine not exceeding NZ$100 (s 20D(3)).
