Only "common fireworks" are legal: Miss. Code § 45-13-1 still uses the older Interstate Commerce Commission "Class C common fireworks" label and requires any item designed to produce an audible effect to contain an explosive composition not exceeding two (2) grains — "safe and sane" items such as cone fountains, small Chinese crackers, and small non-explosive Roman candles and rockets. Paper caps and non-explosive sparklers are not "fireworks" at all; all other manufacture, sale, possession or use is prohibited. § 45-13-9 also bars sales to anyone under 12 and makes it unlawful to ignite fireworks within 600 feet of a church, hospital or school, within 75 feet of where fireworks are stored or sold, or into, from or at a motor vehicle. A violation of the article is a felony (§ 45-13-15). Cities and counties may restrict further.
