Under state air rules (HAR 11-60.1 Subchapter 3), open burning is generally PROHIBITED with limited exceptions (cooking, fire training, and agricultural burning with a valid permit); other open burning needs Department of Health Clean Air Branch approval, and "backyard" burning of garbage and yard waste has been prohibited on all islands since January 2012 (DOH Clean Air Branch page, re-read September 29, 2026). Agricultural operations must hold a DOH Agricultural Burning Permit, and agricultural burning can be further restricted in times of drought, fire hazards or declared "No-Burn" periods. County fire departments separately regulate any allowed outdoor fires — check your county fire department and the DOH Clean Air Branch before burning.
