Consumer (1.4G) fireworks may be used statewide on three designated holidays only — January 1, July 4 and December 31 (Fla. Stat. § 791.08, created 2020). Outside those days chapter 791 still restricts use. A long-standing agricultural and fish-hatchery exemption remains on the books (§ 791.07, unchanged since 1982) and is what retail "waiver" sales rely on. Local governments may still regulate fireworks use, and a recorded HOA declaration may restrict it — though an HOA board may not adopt rules abrogating holiday use.
